A lot of time the MOU contains enforceable terms. That’s basically what it is - the essential terms of the contract (term and base compensation) while smaller issues get worked out (moving expenses, car allowance, etc)

I also heard that Tennessee law has a 3 day cancellation period for state contracts, so that may have some impact as well.

Edit to add- it all depends on the language of this MOU. It could contain a no enforcement provision.
I'm not sure where the lie started that a "memorandum of understanding" is a thing. Either the parties had a contract or they didn't. Was there an exchange of consideration? Were the essential terms defined and agreed to? Etc.

I used to counsel clients never to sign a "memorandum of understanding" (or its evil twin cousin, a "letter of intent"). You've either got a deal or you don't. If you do, call it a contract and get it right. If you don't, what do you think you accomplish by putting all this stuff under signatures? Call it "working proposal" or something if you just like bullet lists.
 
I prefer verbal contracts to memoranda of understanding. Preferably unrecorded and unwitnessed.

A job I was considering two years ago wanted me to sign a letter of intent, but they claimed it to be non binding. to which i asked the purpose of signing it, especially since i had three other offers and was weighing my options at the time. my attorney told me to not sign it.

That was pretty much my point. Once they have agreement and the basic requirements of a contract are met there’s probably some degree of enforceability. Hence why I said lawsuit incoming.
 
Schiano shouldn't be regarded as a pedophile enabler. There's simply not enough evidence, just some hearsay. This guy said that that guy said that Schiano said...

Dangerous trend in our country to blackball anyone for whom there is even the faintest, weakest suspicion of connection to child molestation. How about giving people the benefit of the doubt? If he was not involved, he is being treated terribly unjustly.

If Tennessee doesn't want him because he's not a good coaching fit, fine. But if they don't want him because of some unsubstantiated allegation, they're acting unethically.

Their fan base is so fixated on Gruden that anyone else is going to be already set up for failure. Someone put up a list of the top 5 coaches that Tennessee fans would actually accept without rioting.

1. Jon Gruden
2. Nick Saban
3. Urban Meyer
4. Dabo Swinney
5. Phillip Fulmer
They had Finebaum on the phone talking about it last night and he basically said Gruden, Mullen, and Kelly turned them down. Schiano was not high on their list.
 
Yea, I literally cannot stand him. I don’t think he adds anything. I don’t think he knows anything about the the teams that are playing. He speaks in generalities.
Well, there was that one game he announced where he was literally calling the offensive plays before the snap.

Not that big of a deal. He's just responding to people saying he should go back to Tenn by saying he's happy at FAU. As far as Twitter trolling goes, that's pretty mild.
