NCAA Infractions Appeal Results

Absolutely ridiculous... Is it safe to now refer to Dave Braine's retirement as a "firing"? Thanks Wayne Clough for sticking with his man. This is absolute BS. The punishment does not fit the crime.

Wasn't Paul Griffin responsible for dealing with the appeal? If he was, can we finally fire this clown? I hope Rad is paying attention and cleans house. He's got a ton of dead weight sitting in the GTAA.

Reason #836 to hate Notre Dame:

The members of the Infractions Appeals Committee who heard the case are: Christopher Griffin, Foley & Lardner LLP, chair; William Hoye, University of Notre Dame ; Noel Ragsdale, University of Southern California; Allan Ryan Jr., Harvard University; and Robert Stein, American Bar Association.

Gotta love the NCAA's logic.

[ QUOTE ]
Georgia Tech asserted that the findings of violations II-A-1-c; II-A-1-f; II-A-2-f; and II-A-3-b, which involved football student-athletes who competed while ineligible, should be set aside because those penalties were based on events that occurred prior to the year 2000 and therefore should have been barred by the statute of limitations in NCAA Bylaw 32.6.3.

The Infractions Appeals Committee determined that any statute of limitations issue must be raised in a manner, and at a time, sufficient to provide the Committee on Infractions with a reasonable opportunity to consider the matter.

What kind of BS response is this? Basically, we have a rule that says there is a statute of limitations... but in order for you to be able to claim a statute of limitations you need to give us enough time to consider whether the statute of limitations exists. You failed to let us know before the statute of limitations was up, therefore erasing the ability to use the statue of limitations. What horse shit 2 cent Alabama Lawyer wrote this response. Freaking moron.

Why have a statute of limitations if you aren't going to honor it? Isn't this pretty clear cut?

It looks like a statute of limitations can, in fact, have a statute of limitations...

Well, if it was me I'd appeal this decision too, on the grounds that they obviously don't have a clue what they're doing.

While it does suck, and the NCAA is incompetent as usual, we did get the most important thing back. The guys who suited up in white and gold those years didnt deserve to have their record tarnished, the scholarships will be back eventually but we wouldn't be able to get this any other way.

Is knowledge even a factor when decisions of this nature are made? Sounds like some of the government tax people are working there too.

I agree. We should make this a public relations embarrassment for the NCAA. We should all go to their website and email them. Can't wait to hear lawbee's take on this one. Looks to me like they are backpeddling and clearing their throat and hoping that the entire matter is shoved under the rug. Lets not let them!!!

I certainly hope Rad and/or Clough go onto the 6pm news today and continue to show their dismay. /ubbthreads/images/graemlins/crybaby.gif

We REALLY could have used the 6 extra scholarships this year...we will have to disappoint some good athletes that would have committed to GT.

That's exactly what I thought about the staute of limitations response - what a load of crap!

This ruling makes two things blatantly obvious to me.
1) The comittee doesn't believe our claim that the mistakes were not intentional. Hence the severity of the punishment.

2) It's obvious that we were novices as a defendant and being strip searched and interrogated by the NCAA. We waited MUCH too long to bring in our hired gun.

And another thing, for us not to have made an issue out of the statute of limitations after the first summary review was negligent by whoever was defending us at that point. This whole fargin mess just makes me sick to my stomach. /ubbthreads/images/graemlins/puke.gif

I also understand Paul Griffin led the way for our defense. Not exploiting the statue of limitations loophole would not have been passed up by the lawyer from UGA.

In my opinion, this whole series of events is typical of the arrogance and lack of attention from the Dave Braine era. How you do not hire the best, most experienced legal team to defend a program never on probation because your vacation may be in conflict is beyond me. I do not wish him ill will (or health), but serious work needs to be done in tha AA -including evaulating existing personnel to restore confidence and credibility of this organization in the eyes of many alum.

The real shame, as hivered mentions, is the impact on our recruiting numbers just when this staff has seemed to got it together on recruiting.

Not really.. their image is tainted. Any rival will now say that whatever the records, we cheated to get them. We on this board can argue otherwise, but the reality of perception about GT cheating is alive and well during those years. The average Joe Blow isn't going to analyze the statue of limitations stuff...they just know we got put on NCAA probation with schollies taken away, an appeal denied, and therefore, there must have been real evidence against us. So, in fact, those guys who suited up during those years will be labeled..unfortunately.

Gailey has recruited very average his years here (average to poor this past year due in some part to low schollie availabilty). Now, we get a few early verbals and suddenly the world has changed and Gailey is righting the ship, so to say? Gailey has not had a great season record or football class since arriving at Tech. Suddenly, he gets a few non-binding looksies and all is forgiven. Let see what happens in February before annointing this class. Funny thing is, so many here said they don't pay attention to player's stars or recruiting rankings always taking pride that Gailey found diamonds in the rough. Some folks will stand on both sides of the fence to support our average joe of a coach who is now further hindered again because of fewer schollies to recruit with.

Pulling for GT and Gailey to do well, but geez folks, how many years of middle of the road/mediocroe seasons must continue? Losing to UGA every year, poor bowls, extremely divided fan base, losing games we should win only to win one or two we should lose highlighting coaching inconsistency and poor prep, NCAA probation, etc.. all under Gailey. Glad he isn't to blame, though, since he just signed another multi-million dollar deal to keep the status quo alive and well.

nah...

..the smell is probably just your old crusty yellow tinted glasses that tend to skew reality. /ubbthreads/images/graemlins/wink.gif

Almost no one even knows this is going on. ugag fans do simply because it gives them their first chance to make noise about us being in trouble instead of them. I haven't heard a single word from any other ACC fans about this since it started. It's more a local issue than anything.

"We need to not look at the NCAA staff as our partners but as our adversaries," Griffin said. "If any institution is ever confronted with these type of allegations, the first call is to legal representation, like Bond, Schoeneck & King, and listen to them.".......

Gee Paul,...'ya think??! /ubbthreads/images/graemlins/pat.gif

The sad thing is, this shows the naivety of a group of people who really were trying to be honest and upfront about everything. I hope a valuable lesson was learned.
