I can tell you as a defense lawyer if you have a son who is having sex with a girl <16 y/o then he could go to prison.

Recently a 14 y/o girl was charged with child porn by putting nude pics of HERSELF on line and she may have to register as a sex offender.

It is a crazy world we live in now and if your kid has a cellphone you need to be aware of what they are doing with it.

Yep, its crazy stuff. Prosecutors need to use some reason and logic when it comes to this stuff. I'm all for protecting the innocence of our children, but all you have to do is watch 30 minutes of a "family program" and that is out the window. There are other things (tv, music, videos, etc) getting the kids in bed in the first place. These things are not only legal but are praised. Sadly, the days of Andy and Barney are long gone. :ugh:
 
High school senior has sex with high school freshman.
 
Does anyone remember the case against a teacher for sex crimes because a virus was on the school's laptop? She started a presentation to a class when a virus started all kinds of porn popups. She tried closing them, which just encouraged more to come up. The douchebag prosecutor decided to go full bore against her, pressing all kinds of sex crime felonies. Charges were eventually dismissed on appeal, but her life has been ruined by this ****ing outrage.

This has to stop. Yes the kids involved might be making some poor decisions that they'll regret when they show up later on in life, but I truly doubt most of those consequences are as bad as the sex offender label.

Many times the prosecutors are strapped by stupid laws written by overzealous legislators trying to score political points,we do not have a JUST society.
 
Hmm, not sure what to think of this. On one hand, he was not acting very responsible by getting involved in an extremely risky act that could jeopardize his entire future, but on the other hand, he was just acting like another stupid high school student by having sex with someone from, most likely, his own school.

Prosectors do not have to bring the case. And just to make sure everyone understands, I'm not condoning the behavior. If I was the girl's dad, I'd probably be charged with murder.

If I was the district attorney, I would not ruin this kid's life by having him on a sex offender website the rest of his life.
 
prosecutors DO NOT have to bring cases HOWEVER they do have to listen to their BOSS the elected DA.

So if you have a ZEALOUS DA that is an ELECTED official he will routinely force the prosecutor to bring these types of cases.

But it really is not a CLEAR case that these cases should not be brought. Do we want 14 y/o girls PREGNANT whether it is w/ a 15y/o or 18 y/o daddy.

Also I guess you could say don't criminalize this behavior but it is a VERY complicated issue.

I can tell you that THESE problems are the result of NO VALUES in the school and the home. Teachers think they can bang their students and it seems that MANY parents don't care

I can tell you that Tenn and California build prison space on the quality of 3RD GRADERS TEST SCORES.

I like posting articles like this and then read the responses and how people view this problem.

The prosecutor also listens to the family of the "victim." These are just issues that the prosecutor must weigh, but if the facts are simply that 2 high school kids had sex, and both were in agreement to do so, then I would not bring the case. If there was a teacher involved, that is a totally different story.

Since I didn't read the article, I won't comment on this case in particular. But, I don't want 18 y/o seniors to have to register as sex offenders for the rest of their life for having sex with high school freshmen. In fact, I think that punishment is unconstitutional as it is clearly cruel.

We used to have a reasonable punishment for this kind of behavior. It was called marriage.

:biggthumpup: Brilliantly stated. I don't think the punishment is unconstitutional though. The law is there for good reason, but it shouldn't be used for bad.

The law is fine, but it shouldn't be automatic. Let a judge decide on what is reasonable in a specific case. Two high schoolers playing doctor shouldn't result in a lifelong banishment from polite society. Now if the sex wasn't consentual or if the guy was 28 instead of 18, things are different.

I have never seen anything good come from the proposition that the legislature should draft broad laws and hope the courts and enforcing officials (be they agencies or prosecutors) will construe them narrowly.

Their is a wrong here that these laws are trying to deal with. But the overwhelming evidence suggests that prosecutorial discretion is not capable of doing the work that well drafted, narrow legislation could do. Nor is relying on the bench the smart thing to do (especially for those who claim not to like judicial activism on either side of the aisle).
