Charges could be upgraded to murder.
Apparently the victim was drunk and banging on Jones' car outside a hotel, looking for an Uber he had called for. It probably depends on what transpired after Jones got out of his car that led to the punch, but I think a good lawyer will be able to make a case for self-defense. Fleeing the scene after knocking a guy out will be hard to explain, though.
17 year-old witness:
"Me and the man, we picked him up and leaned him against a car so he would stop choking on his blood until the ambulance came," the witness said.
Any recruits we can steal from this?
Yeah. I don’t know if the guy would get charged with murder in a place like Florida, but this is New York
That story leaves a lot to the imagination in terms of what happened to provoke the punch. If he literally just hopped out and cold-cocked the guy knocking on his car window, he should definitely go down for at least manslaughter.
That seems a stretch. Malice aforethought etc.?
That’s what the article said, and I thought the same thing. But, felony battery plus a death equals felony murder
I do like the felony murder rule... but this sounds like voluntary manslaughter at worst.
And in Ga (at least) felony battery is very hard to establish and doesn’t fit these facts.
