Well, Tulane tried the antitrust route. They failed.

That's why I said "at best." Which means that you could file a complaint without being sanctioned by the court before it dismissed the case.

Thanks for clearing that up, my comments were also meant as a defense of GTBandit.

As to private parties, you are right that it is a complex discussion. I have reasons for believing that I am right, as I'm sure you do to. However, I'm not in the mood for a very long legal conversation as I have very long legal arguments to write on other issues and I'm procrastinating right now.

Only major league baseball has an antitrust exemption. None of the other pro sports do (remember the USFL, as well as the Arena league).
 
Do not think the draft is antitrust -- that is part of the NFL --- remember Herschel originally was drafted by USFL--as they paid more?

Right now, the reason there is a monopoly on NFL is because it is hard to put a product on stage that can compete with it -- they have the best players, so other leagues look inferior. However, noone is preventing you from forming a league. MLB actually has an antitrust exemption written into law -- which is part of the reason the players cannot go anywhere else in the US to play ball, even during strikes.

They are preparing to start a spring pro-football league again. I don't know if they are working with NFL on that one.

I'm pretty sure they have at least some exemption from them. That's why they could bar Clarette from entering the draft when he wanted to. Could be wrong though.

And now that I think about it, the antitrust exemption thing came up again with regards to DirecTV being the only way to get the Sunday Ticket package.

This actually hurts tech IMO. We have a better shot without the playoff to win a MNC.

I agree, and I've said so before. Us being in a lesser BCS conference central to a regional media nexus drastically improves our chances at a MNC. Moving football to a playoff hurts Tech.
 
I have no problem with Congress spending months on the BCS. The more time, the better. Everything Congress touches turns to crap, so keep them away from the economy. And the BCS can't get much crappier than it already is.
 
What really gets to me is that congress and most people don't get the real point here. That is, the NCAA still doesn't have a champion for D-1A football. The BCS conferences created a mechanism to crown their champion, and while they may call it a national championship it's not. What Swofford should be telling congress is that if the NCAA presidents vote to have a championship, then the BCS schools will decide if they want to participate or not. Until then, they will continue to run their own little championship deal and let others participate as they see fit.

Not if teams don't have a month to prepare for our system. All in all, I think the players deserve a real championship though. They play hard and devote their life to football. They deserve to have the champ declared on the field - not the high rise offices of some old guys stuck to their ways.

damn, my apologies, gth -- I was always told/under the impression that only baseball had the antitrust -- and that was how the USFL was able to come into existence. That wash post article proves me wrong.
