Here is the introductory part of the Infraction Committee's response:

"As noted in the infractions report (Exhibit 1, p. 16), this case involved all of the factors identified by the COI (and by the IAC) as particularly relevant to imposition of a vacation penalty in a major case:

- There were a large number of violations committed by three institutional staff members and at least 61 student athletes in 10 different sports;

- The violations were serious and intentional;

- Student athletes competed while academically inelegible;

- There was an unconetested finding of institutional failure to monitor various aspects of the AASS program;

- There was widespread academic fraud; and

- Three institutional staff members in the AASS program engaged in unethical conduct by encouraging and/or participating in the academic fraud. Their involvement was especially egregious because of their positions as individuals charged specifically with maintaining academic integrity in the athletics program.

In light of these aggravating factors, the university cannot begin to make its required showing that the vacation of records is "excessive such that it constitutes an abuse of discretion" by the Committee on Infractions. Thus, [FSU] takes every opportunity to try to minimize the violations and to deflect attention from the wrongdoing by portrayiong this case as some sort of "philosophical" battle between the COI and the IAC. At bottom, though, this case is about dozens of student-athletes (aided by their academic advisors) cheating, gaining fraudulent academic credit, and then competing while ineligible due to their academic misconduct. Under such circumstances, what possibly could be fair about allowing the contest results to stand?"

some responses by F$U fans

some of it is news... or at least I didn't hear it before...

like that the athletes were "funneled" into this class by an institutional employee and then further funneled to the tutor who would cheat for them so they could get a high grade

Or that the test itself had printed right on it that they are not allowed receive any help when taking this test, sort of blows the theory that they didn’t even know they were cheating.

Or that there actually is several case precedents for vacating wins when coaches aren’t involved.

if (getCookie("HideSigs") != 1) {document.writeln('-The Bowden Way0-');}

I guess the GT case is the standard and now will be listed everytime someone appeals their penalty.

Wait, the NCAA actually found some balls and stood against a football factory?

Did they get probation or lose any schollies?
Four years probation. They lost six total scholarships. From an older article:

The football team will be limited to 83 total scholarships in 2008-09; 82 in 2009-10; and 84 in 2010-11; the maximum usually allowed by the NCAA is 85. Florida State self-imposed the loss of the two scholarships for 2008-09, and will self-impose the loss of three scholarships for 2009-10. The NCAA added an additional loss of scholarship from the maximum in 2010-11.

FSU is contesting the vacation of wins to preserve St. Bobby's quest to over take the zombie known as Paterno. If you read what the infraction committee said, FSU got a better deal the OJ did. Maybe Wetherell should devote some time on the golf course looking for the real cheaters.

Just watch CFB live piece on FSU. Mark May was breaking down their (FSU) schedule, and he actually favor GT over FSU.

Mark May is one of the few talking heads who actually gets it... He was on board with GT last season...

I can't believe that FSU and Bama have not lost scholarships because of this. They should be playing with about 50 schollies right now.

FSU lost six total. The NCAA said that they only deserved one extra then the self imposed sancations they gave themselves. One. Let that sink in. Then realize that Wetherell and some talking idiots on ESPN are acting like the NCAA walked into Bobby Bowden's house, drank all his expensive bourbon, made out with his daughter, and urinated in his sink, before doing donuts in his front yard while leaving. It's even more ridiculous when you look at the sancations we were handed due to administration-gate a few years back.

I don't get why Alabama, a repeat offender, only gets vacated wins.

Vacated wins seems to be the en vogue wink/nod the NCAA gives to its bigger programs.

Wetherell's quote is particularily amusing. I really don't think he gets it.

Actually, the Bowden quote is more amusing:

"Joe, who I love to death, he and I got a battle that neither one of us thought would ever happen," Bowden told WBRC-TV in Birmingham after a round of golf Thursday. "Joe would not want to win this thing the way they [NCAA] are doing this."

Actually, Joe has made a conscious decision to run a clean program, so he's probably fine with you being justly punished for breaking the rules. It makes me want to throw up that he's making this about his record, which is so arrogant I can't even think straight about it.

Bowden's bull**** doesn't carry much weight anymore. Hope you are doing well Techphi97. Hope to see you this football season. i'm taking JD to the VT game. Might be two weeks after are second baby is born, but hey, I gotta go to that game!

Also, I beg to differ on ole Joepa running a clean program. They've had a large amount of thuggery and drug issues that didn't even warrant player suspensions. But I think Bowden's quote is hysterical. He just doesn't get it.
