First off let me say that I completely agree with RamblinPeck...Lets wait for it all to play out. And let me say that I am in no way taking up for the player.

But this does raise an interesting question and for the sake of batting the ole ball around lets ask it.

Based only on the info in this article we are basically talking about one thing. The span of time between when she said NO or STOP, and he stopped.

If I read this correctly there are several things that are not disputed.

1. She voluntarily went to his room.
2. At some point he preformed oral sex on her with her consent.

So the real question is when did that consent end from her....and when did he stop. And how much time between the 2 constitute a crime? 5 seconds, 10 seconds?

Had they both been drinking? If so the waters get even muddier....considering time moves at a different speed for those intoxicated. Hearing is impaired for those intoxicated.

OK, not that I am the DON JUAN of lovers, but....

1) EVERY TIME I have been asked to STOP that act, its over. Like 99.99% of red-blooded American men. It aint that fun.

2) I didn't read about ropes, chains, etc. So, we have to assume it was one of the "normal" positions when all this began. HOW THE HECK could the D have MADE the V stay in the receiving position? She didnt push him off? kick? or just GET UP?

I would assume, to your point, that the reason there wasn't pushing, shoving or kicking him off, would be because she was so drunk she couldn't fight him off?

Also based on the quote from the article above the phrase "despite her continued pleas to stop" would lead me to believe that my original question of time between her asking and his stopping is moot. Since if she had to continue to plea, then he was way past the point of question?

Also the testimony of the witnesses to her demeanor both before and after the incident shows that she defiantly felt like she was wronged in someway.

Her upset demeanor may have been the guilt of her actions. Who Knows?
 
Ignorant question here, does the law distinguish from this kind of rape and other kinds? I guess what I am asking is this treated the same as someone who hides in the bushes and attacks someone?

Actually the law does NOT distinguish facts in the state of GA. Rape has a mandatory minimum of 10yrs but it is up to the judge to sentence and I can tell you that if a jury comes back with guilty you will get hammered as was proven by the high school kid they recently let out of jail.

In Texas the jury decides the sentence (I believe) and they can appreciate facts IMO.

If you go to trial and lose on this type of case you can expect 10+ years. That is why a plea will always be discussed, however it would require sex offender registration which would probably take that off the table.

I'm with you. Unless you are holding her down or forcing yourself on her, there is nothing wrong with getting a few extra pumps in, maybe throw in a "what? why? what's wrong?" while you're at it. Guess we're dirtbags, but by no means rapists. come on people.

Sounds to me like she said stop and he thought he might get a few extra strokes in to convince her otherwise but it didn't work. A womain in the cunnilingus position shouldn't find it too hard to wiggle away. Suppose she had to wiggle away to make him stop, just 3 or 4 seconds after she told him to stop...is that rape? Hell no. Its a woman taking control over the situation.

And since we're on the topic, I should say that the reverse is true as well. I dated a girl once who I think wanted me to impregnate her. We were about to get it on and she insisted that I don't use a condom. When I refused, she kept forcing herself on me to the point where I literally had to push her off of me a couple of times. I wasn't traumatized! I didn't run screaming and crying from the room. I stopped dating her, and that was the end of it. I don't think she should be put on trial for rape, and I sure don't think she should lose her job or her freedom.

I will say this... I'm not a father but if I was and you did that to my daughter I would come after you a$$ with shotgun for real. No means no man. And that's what the law says. Of course it's always a different situation at the time so who knows...

But honestly the second a women says to stop is the second rape begins. If there is ever sexual contact of any type that is against the women's will it is rape. So if she said stop, but he kept on going to the point where she had an orgasm, but was till saying "stop" then it was technically rape.

But that's where everything greys because as a married man, half of the time my wife and I copulate, it begins with "not right now honey, I'm tired" and eventually turns into "dont stop" so who really knows what the hell a woman really wants. It's bunch of confusing mess and it's likely that he thought "she seems to be enjoying it so until she physically stops me im going to keep going". But the problem is she still said "no".

Let's put it this way... Being the man sucks in those situations!

I agree that "no means no". However, "yes means yes" and if it's followed by a "maybe we shouldn't..." halfway into the act, that means "give me a few more pumps and call it quits". At least in my book.

Maybe there's confusion per my original comment. I've never held a woman down against her will while she's kicking and screaming for me to stop.
 
I'm pretty sure that if one party says something in regards to sex, that's what it means. Not "Just a little more."
