Ya. I don't see how this could hold up in court. Basically he said, she said since there is no evidence of rape. If a person's head is in the position, you could easily knee him in the head, or jab him in the eye or something to get away.

Just doesn't add up. Hope this all gets straightened up one way or another.

Really just another example of AJC "journalism." Not that any reporters are much better these days. News in general has jumped the shark to just another entertainment medium looking to get the biggest number of impresions in a short amount of time.
 
I'm not a lawyer, but if it's "oral rape" we're talking about here what case could she possibly have? Like 33 said, where's the evidence?



disclaimer: I'm not judging either way about his guilt or innocence, I'm honestly just curious about how this would go in court.

He said they didn't have sex at all and the headline paints him like every rapist in history "SHE WANTED IT DUDE" instead of what he actually said.
 
Not to make light of the situation, but we now have a solid argument to stay north of the equator, gentlemen and/or flannel wearing ladies.
